Messaging Terms

These Messaging Terms govern the Gracie Barra Seminole text message (SMS) and calling program (the "Program"). They apply in addition to our Terms of Service and Privacy Policy. By providing your phone number and opting in to marketing communications, you agree to these Messaging Terms.

1. Program Description

If you provide your phone number and check the optional marketing consent box on our contact or booking form, Gracie Barra Seminole may send you marketing and promotional text messages and place marketing and promotional calls to the number you provided. These may include class schedules and reminders, promotions and special offers, event announcements, membership information, and related updates about Gracie Barra Seminole. We send these messages and place these calls only to numbers provided to us with consent.

2. Consent Is Not a Condition of Purchase

Your agreement to receive marketing text messages and calls is optional. Consent is not a condition of purchasing any goods or services, booking any class, or submitting any inquiry. You can use our services and complete a booking without agreeing to receive marketing messages.

Message and data rates may apply. Your mobile carrier's standard message and data rates, fees, and charges will apply to any messages you send or receive. Please contact your wireless carrier for details about your plan.

5. How to Opt Out

You can opt out of marketing text messages at any time. Reply STOP to any text message you receive from us to unsubscribe. After you reply STOP, we may send you a single confirmation message acknowledging that you have opted out, after which we will stop sending you marketing text messages. To stop marketing calls, you may tell us during a call or contact us using the details below.

7. Revoking Consent

You may revoke your consent to receive marketing text messages and calls at any time, by any reasonable means. This includes replying STOP to a text message, telling us during a call, or contacting us at the email or phone number below. We will honor your request within a reasonable time as required by applicable law.

8. Carrier Disclaimer

Carriers, including wireless carriers, are not liable for delayed or undelivered messages. Delivery of messages depends on effective transmission by your wireless carrier and is not guaranteed. Gracie Barra Seminole is not responsible for messages that are delayed, misdirected, or not delivered.

9. Supported Carriers and Devices

Message delivery depends on your wireless carrier's network and your device and is not available on all carriers or in all areas. To receive text messages, you must have a text-capable mobile device.

10. Privacy

Information you provide in connection with the Program is handled as described in our Privacy Policy. We do not sell your mobile phone number, and we do not share it with third parties for their own marketing. We use service providers, including our website and messaging provider, only to deliver messages and operate the Program on our behalf.

11. Current Status of Automated Messaging

We do not currently send automated, autodialed, prerecorded, or artificial-voice (including AI-voice) marketing calls or text messages. We collect marketing consent now so that, if we later activate automated messaging, we may contact consenting individuals without asking again. Before activating any automated dialing system or any prerecorded, artificial, or AI-voice messaging, we will provide any additional disclosures required by the Telephone Consumer Protection Act (TCPA), the Florida Telephone Solicitation Act (FTSA), and other applicable law.

12. Changes to These Messaging Terms

We may update these Messaging Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued participation in the Program after an update means you accept the updated Messaging Terms.
